The Perennial Truth Foundation is a Private Non Profit Cause and Meditation Sanctuary, serving The Greater Good. Tjaart and Karen Kruger are sole Trustees of the Foundation. The Foundation is managed by Volunteers who are trusted by Tjaart and Karen. All Rights are Reserved by the Foundation.
Maha Khala is a globally registered trademark of The Trust. We do not have practitioners or facilitators. We believe that you can be your own teacher and coach and the Maha Khala course is open and free to all for their personal self growth and journey.

This Privacy Policy explains how The Perennial Truth, Know Thy Ego, Samaya Tantra, School of Samaya (“SOS”) and MahaKhala.com (“Maha Khala”, “we” or “us”) collects, uses, and discloses information about you when you access or use our websites, mobile application, and other online products and services (collectively, the “Services”), and when you contact our customer service team, engage with us on social media, or otherwise interact with us.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.
1. Collection of Information
1.1 Information You Provide to Us
We collect information when you register for an account, participate in interactive features (like submit a meditation rating), fill out a form or a survey, participate in a contest or promotion, make a purchase, communicate with us via social media sites, request customer support, or otherwise communicate with us. The information you may provide includes your name, email, password, goals, previous meditation experience, street address, payment method information, feedback and survey responses, and other information about you included within your messages to us. Some users also provide health-related information in connection with providing feedback or other messages to us, and we process that information consistent with the purpose for which it was provided.
2. Other Information About Your Use of the Services
When you use our Services, we collect the following information about you:
- Usage Information: Whenever you use our Services, we collect usage information, such as the sessions you use, videos you view or music you listen to, what screens or features you access, and other similar types of usage information.
- Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product description, price, subscription or free trial expiration date, and time and date of the transaction.
- Log Information: We collect standard log files when you use our Services, which include the type of web browser you use, app version, access times and dates, pages viewed, your IP address, and the page you visited before navigating to our websites.
- Device Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, device identifiers set by your device operating system, and mobile network information (like your connection type, carrier and region).
- Information we Generate: We generate some information about you based on other information we have collected. For example, like most platforms, we use your IP address to derive the approximate location of your device. We also use your first name to make an educated guess about your gender and use information about your activity to help determine the likelihood of you continuing to use our Services in the future (which we hope will be the case!).

3. Information We Collect from Other Sources
We also obtain information about you from other sources, including transaction information from third-party app stores you use to install our app or purchase a subscription and name and contact information from third-party calendar services. Additionally, if you create or log into your account through a social media service account, we will have access to certain information from that account, such as your name and other account information, in accordance with the authorization procedures set by that social media service.
4. Use of Information
We use the information we collect to:
- Provide, maintain and improve our Services, and develop new products and service;
- Process transactions and fulfill orders;
- Send you transactional or relationship messages, such as receipts, account notifications, customer service responses, and other administrative messages;
- Communicate with you about products, services, and events offered by ‘SOS’ and others, request feedback, and send news, gifts or other information we think will be of interest to you;
- Monitor and analyze trends, usage, and activities in connection with our Services;
- Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of “SOS” and others. If you feel your transaction was declined in error, please contact us for assistance at info@schoolofsamaya.org;
- Comply with the law, such as by processing transactional records for tax filings;
- Personalize your online experience and the advertisements you see on other platforms based on your preferences, interests, and browsing behavior; and
- Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards.
5. Sharing of Information
We share information about you as follows and as otherwise described in this Privacy Policy:
- With companies and contractors that perform services for us, including email service providers, payment processors, fraud prevention vendors and other service providers;
- In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
- If we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of “SOS” or others;
- In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
- Between and among “SOS” and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
- With your consent or at your direction. For instance, you may choose to share actions you take on our Services with third-party social media services via the integrated tools we provide via our Services.
We also share aggregated or other information not subject to obligations under the data protection laws of your jurisdiction with third parties. For example, we sometimes share aggregate information with research organizations to help facilitate their research.
6. Advertising and Analytics Services Provided by Others
We allow others to provide analytics services and serve advertisements on our behalf across the web and in mobile applications. These entities use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Services and other websites and online services, including your IP address, device identifiers, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. This information may be used by “SOS” and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites and online services, and better understand your online activity. 7. Data Transfer
“SOS” is based in South Africa and processes information in South Africa, which may not provide equivalent levels of data protection as your home jurisdiction.
8. Your Choices
8.1 Account Information
You may update certain account information you provide to us (such as your password, name and email address) by logging into your account or contacting us through our Help Center at info@schoolofsamaya.org. If you wish to disable your account, please contact us at schoolofsamaya.org, but note that we retain certain information when required or permitted by law. We also retain cached or archived copies of information about you for a certain period of time.
8.2 Promotional Communications
You may opt out of receiving promotional emails from “SOS” by following the instructions in those emails or by logging into your account. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
8.3 Mobile Push Notifications/Alerts
With your consent, we send promotional and other push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
9. Information for Individuals in Switzerland, UK and the EEA
The sections below apply to you if you use our Services while in Switzerland, the United Kingdom or the European Economic Area (collectively, “Europe”).
10. Legal Basis for Processing
When we process your personal data we will only do so in the following situations:
- As necessary to perform our responsibilities under our contract with you (like processing payments and providing the products or services you have requested);
- When we have a legitimate interest in processing your personal data, including to communicate with you about changes to our Services, to help secure and improve our Services (including to prevent fraud) and to analyze use of our Services;
- As necessary to comply with our legal obligations; and
- When we have your consent to do so.
11. Data Retention
We retain personal data for no longer than is necessary for the purposes for which it is processed, unless applicable law requires storage for a longer period of time.
12. Data Subject Requests
Subject to certain limits and conditions provided under law, you have the following rights:
- You have the right to access personal data we hold about you and to ask that your personal data be corrected, erased, or made available in a portable form.
- You also have the right to object to certain processing (like receiving direct marketing), or request that we restrict processing in certain circumstances (like to retain but not further process pending resolution of a claim).
- When we ask for your consent, you may withdraw that consent at any time.

13. Information for California Residents
This section provides additional disclosures required by the California Consumer Privacy Act (or “CCPA”).
In the last 12 months, we collected the following categories of personal information: identifiers (such as name, contact information and device identifiers), internet or other electronic network activity information (such as browsing behavior), approximate geolocation data, inferences (such as approximate location or product interests) and other personal information (such as payment method information, user credentials or health-related information). For more details about the personal information we collect, including the categories of sources, please see the “Collection of Information” section above. We collect this information for the business and commercial purposes described in the “Use of Information” section above. We share this information with the categories of third parties described in the “Sharing of Information” section above.
Subject to certain limitations and exceptions, the CCPA provides California consumers the right to request to know more details about the categories and specific pieces of personal information, to delete their personal information, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights.
We do not “sell” the personal information we collect (and will not sell it in the future without providing a right to opt out).
California consumers may make a rights request by emailing us at support@schoolofsamaya.org. We will verify your request by asking you to provide information that matches information we have on file about you. Consumers can also designate an authorized agent to exercise these rights on their behalf, but we will require proof that the person is authorized to act on your behalf and may also still ask you to verify your identity with us directly.

Welcome to The Perennial Truth Foundation (“TPTF”) with our website located at www.theperennialtruthfoundation.org (the “Site”). TPTF provides you with meditation techniques, spiritual understanding, metaphysical healing programs and self mastery resources (Services) accessible via our Site, social media platforms and our mobile device application (“App”). To make these Terms easier to read, the Site, our Services and App are collectively called the “Services.” Please read these Terms of Service (the “Terms”) carefully because they govern your use of our Services.
1. Agreement to Terms
By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services. You agree to use our services, completely, at your own risk.
2. Privacy Policy
Please refer to our Privacy Policy for information on how we collect, use and disclose information from our users. You acknowledge and agree that your use of the Services is subject to our Privacy Policy.
3. Changes to Terms or Services
We may modify the Terms at any time, in our sole discretion. If we do so, we’ll let you know either by posting the modified Terms on the Site or through other communications. It’s important that you review the Terms whenever we modify them because if you continue to use the Services after we have posted modified Terms on the Site, you are indicating to us that you agree to be bound by the modified Terms. If you don’t agree to be bound by the modified Terms, then you may not use the Services anymore. Because our Services are evolving over time we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.
4. Arbitration Notice
Unless you opt out of arbitration within 30 days of the date you first agree to these terms by following the opt-out procedure specified in the “Arbitration” section below, and except for certain types of disputes described in the “Arbitration“ section below, you agree that disputes between you and ‘TPTF’ will be resolved by binding, individual arbitration and you are waiving your right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.
5. Who May Use our Services
5.1 Eligibility
You may use the Services only if you are 18 years or older and are not barred from using the Services under applicable law. To make a purchase via the Services (described in the Section titled “Purchases” below), you must be 18 years or older and capable of forming a binding contract.
6. Registration and Your Information
If you want to use certain features of the Services you’ll have to create an account (“Account”). You can do this via the App or the Site or through your account with certain third-party social networking services such as Facebook (each, an “SNS Account”). If you choose the SNS Account option we’ll create your Account by extracting from your SNS Account certain personal information such as your name and email address and other personal information that your privacy settings on the SNS Account permit us to access.
It’s important that you provide us with accurate, complete and up-to-date information for your Account and you agree to update such information, as needed, to keep it accurate, complete and up-to-date. If you don’t, we might have to suspend or terminate your Account. You agree that you won’t disclose your Account password to anyone and you’ll notify us immediately of any unauthorized use of your Account. You’re responsible for all activities that occur under your Account, whether or not you know about them.
7. Using the Services
Via the Services, users are taken on a guided journey towards the awakening of their soul. The Services offers various membership plans with 7 day money back guarantee access to its programs. You can also use the paid functionality of the Services to utilize the Shop functionality of the Services or purchase items that are offered for sale through the Services (the “Products”), as described in further detail under the Section titled “Purchases” below. Please note the refund and cancelation policies of each product prior to finalising your purchase.
You understand and agree that the Services, Products and any other information you learn from “TPTF” , The Perennial Truth and Maha Khala are not intended, designed, or implied to diagnose, prevent, or treat any condition or disease, to ascertain the state of your health, or to be a substitute for professional medical care. Not all activities described on the Services or Products are suitable for everyone. Do not use the Services while driving, operating heavy machinery, or performing other tasks that require attention and concentration. Nor should you practice the advance stages of the meditation processes alone. You understand and agree that you are solely responsible for your use of the Services.
8. Purchases
8.1 Fees
‘TPTF’ offers certain enhanced features of the Services which you can purchase as a yearly subscription (“Subscription”). A description of features associated with Subscriptions is available via the Services. When you purchase a Subscription or a Product (each, a “Transaction”), we may ask you to supply additional information relevant to your Transaction, such as your credit card number, the expiration date of your credit card and your address(es) for billing and delivery (such information, “Payment Information”). You represent and warrant that you have the legal right to use all payment method(s) represented by any such Payment Information. The amounts due and payable by you for a Transaction through the Services will be presented to you before you place your order. If you choose to initiate a Transaction via the Services, you authorize us to provide your Payment Information to third party service providers so we can complete your Transaction and agree (a) to pay the applicable fees and any taxes; (b) that ‘TPTF’ may charge your credit card or third party payment processing account, including, but not limited to, your account with the app store or distribution platform (like the Apple App Store, Google Play or the Amazon Appstore) where the App is made available (each, an “App Provider”), for verification, pre-authorization and payment purposes; and (c) to bear any additional charges that your App Provider, bank or other financial service provider may levy on you as well as any taxes or fees that may apply to your order. You’ll receive a confirmation email after we confirm the payment for your order. Your order is not binding on ‘TPTF’ until accepted and confirmed by ‘TPTF’. All payments made are non-refundable and non-transferable except as expressly provided in these Terms.
If you have any concerns or objections regarding charges, you agree to raise them with us first and you agree not to cancel or reject any credit card or third party payment processing charges unless you have made a reasonable attempt at resolving the matter directly with “TPTF”.
“TPTF” reserves the right to not process or to cancel your order in certain circumstances, for example, if your credit card is declined, if we suspect the request or order is fraudulent, or in other circumstances “TPTF” deems appropriate in its sole discretion. “TPTF” also reserves the right, in its sole discretion, to take steps to verify your identity in connection with your order. You may need to provide additional information to verify your identity before completing your Transaction (such information is included within the definition of Payment Information). “TPTF” will either not charge you or refund the charges for orders that we do not process or cancel.
9. Title, Risk of Loss
The risk of loss and title for Products purchased by you pass from “TPTF” to you on shipment from a third parties facility. All shipments are governed in accordance to third party terms and conditions. “TPTF” and its affiliates are exempt from any liabilty whatsoever.
10. Return Policy
If for any reason, you are not satisfied with the Product you have purchased and you want to return the Product, please refer to our Returns Policy for information on how you may return eligible Products.
11. Subscriptions Automatically Renew Annually Until You Cancel & How to Cancel Your Subscription
All amounts are payable and charged for yearly subscriptions, at the beginning of the subscription and, because each such subscription renews automatically for an additional period equal in length to the expiring subscription term until you cancel it, at the time of each renewal until you cancel, using the Payment Information you have provided. You must cancel your monthly or yearly Subscription before it renews to avoid the billing of the fees for the next Subscription period. If you purchase your Subscription via the Site, you can cancel the renewal of your subscription at any time by contacting us by email at support@theperennialtruthfoundation.org. If you purchase your Subscription via an App Provider, you can cancel the renewal of your subscription at any time with the App Provider. You will not receive a refund for the fees you already paid for your current subscription period and you will continue to receive the Services ordered until the end of your current Subscription period.
12. Changes to Price Terms for Subscriptions
“TPTF” reserves the right to change its pricing terms for Subscriptions at any time and “TPTF” will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply retroactively and will only apply for Subscription renewals after such changed pricing terms have been communicated to you. If you do not agree with the changes to TPTF’s pricing terms then you may choose not to renew your Subscription in accordance with the section “Subscriptions Automatically Renew Until You Cancel & How to Cancel Your Subscription.” You agree to be bound by the terms in respect of renewal and/or cancellation of your subscription.
13. Future Functionality
You agree that your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by “TPTF” regarding future functionality or features.
14. Feedback
We welcome feedback, comments and suggestions for improvements to the Services or Products (“Feedback”). You can submit Feedback by emailing us at support@theperennialtruthfoundation.org. You grant to us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicenseable and transferable license under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon and otherwise exploit the Feedback for any purpose.
15. Content and Content Rights
For purposes of these Terms, (i) “Content” means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services; and (ii) “User Content” means any Content that users (including you) provide to be made available through the Services. Content includes without limitation User Content.
16. Content Ownership
“TPTF” does not claim any ownership rights in any User Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit your User Content. Subject to the foregoing, “TPTF” and its licensors exclusively own all right, title and interest in and to the Services and Content, including all associated intellectual property rights. You acknowledge that the Services and Content are protected by copyright, trademark, and other laws of the United States and foreign countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Services or Content.
17. Rights in User Content Granted by You
By making any User Content available through Services you hereby grant to “TPTF” a non-exclusive, transferable, sublicenseable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform and distribute your User Content in connection with operating and providing the Services and Content to you and to other users.
18. Rights in Content Granted by “TPTF”
Subject to your compliance with these Terms, “TPTF” grants you a limited, non-exclusive, non-transferable, non-sublicenseable license to download, view, copy and display the Content solely in connection with your permitted use of the Services and solely for your personal and non-commercial purposes.
19. Rights and Terms for Apps
19.1 Rights in App Granted by “TPTF” and Maha Khala
Subject to your compliance with these Terms, “TPTF” grants you a limited non-exclusive, non-transferable, non-sublicenseable license to download and install a copy of the App on a mobile device or computer that you own or control and to run such copy of the App solely for your own personal non-commercial purposes. “TPTF” reserves all rights in and to the App not expressly granted to you under these Terms. You may not copy the App, except for making a reasonable number of copies for backup or archival purposes. Except as expressly permitted in these Terms, you may not: (i) copy, modify or create derivative works based on the App; (ii) distribute, transfer, sublicense, lease, lend or rent the App to any third party; (iii) reverse engineer, decompile or disassemble the App; or (iv) make the functionality of the App available to multiple users through any means.
20. Additional Terms for App Store Apps
If you accessed or downloaded the App from the Apple Store, then you agree to use the App only: (i) on an Apple-branded product or device that runs iOS (Apple’s proprietary operating system software); and (ii) as permitted by the “Usage Rules” set forth in the Apple Store Terms of Service.
If you accessed or downloaded the App from an App Provider, then you acknowledge and agree that:
- These Terms are concluded between you and “TPTF”, and not with App Provider, and that, as between “TPTF” and the App Provider, “TPTF”, is solely responsible for the App.
- App Provider has no obligation to furnish any maintenance and support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify App Provider and App Provider will refund the purchase price for the App to you (if applicable) and, to the maximum extent permitted by applicable law, App Provider will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of an App to conform to any warranty will be the sole responsibility of “TPTF”.
- App Provider is not responsible for addressing any claims you have or any claims of any third party relating to the App or your possession and use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, “TPTF” will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms.
- App Provider and its subsidiaries are third-party beneficiaries of these Terms as related to your license of the App, and that, upon your acceptance of the terms and conditions of these Terms, App Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms as related to your license of the App against you as a third party beneficiary thereof.
- You must also comply with all applicable third-party terms of service when using the App.
- You agree to comply with all U.S. and foreign export laws and regulations to ensure that neither the App nor any technical data related thereto nor any direct product thereof is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations. By using the App you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government or South African Government or United Kingdom Government or European Union or Australian or New Zealand embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list or any other country as above mentioned of prohibited or restricted parties.
21. Prohibitions
You agree not to do any of the following:
- Copy, post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; or (vii) promotes illegal or harmful activities or substances;
- Use, display, mirror or frame the Services, or any individual element within the Services, SOS’s, The Perennial Truth or Maha Khala or any of its subsidiary’s name, any “TPTF” trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without “TPTF’s express written consent;
- Access, tamper with, or use non-public areas of the Services, TPTF’s computer systems, or the technical delivery systems of TPTF’s providers;
- Attempt to probe, scan, or test the vulnerability of any “TPTF” system or network or breach any security or authentication measures;
- Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by “TPTF” or any of TPTF’s providers or any other third party (including another user) to protect the Services;
- Attempt to access or search the Services or download Collective Content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by “TPTF” or other generally available third party web browsers;
- Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;
- Use any meta tags or other hidden text or metadata utilizing a “TPTF” trademark, logo URL or product name without TPTF’s express written consent;
- Use the Services for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms;
- Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive or false source-identifying information;

- Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;

- Impersonate or misrepresent your affiliation with any person or entity;
- Violate any applicable law or regulation; or

Although we’re not obligated to monitor access to or use of the Services or Content or to review or edit any Content, we have the right to do so for the purpose of operating the Services, to ensure compliance with these Terms, and to comply with applicable law or other legal requirements. We reserve the right, but are not obligated, to remove or disable access to any Content, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects the Services. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

The Services and App may contain links to third-party websites or resources eg Youtube, Podcast Providers, Blog Hosts, Social Media Platforms etc. We provide these links only as a convenience and are not responsible for the content, products or services on or available from those websites or resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from, your use of any third-party websites or resources.
23. Termination
We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you. You may cancel your Account at any time by sending an email to us at support@theperennialtriuthfoundation.org. If you purchase Subscription via an App Provider, you should also cancel your Subscription with the App Provider directly. Upon any termination, discontinuation or cancellation of Services or your Account, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
24. Warranty Disclaimers
The Services, Products and Content are provided “as is,” without warranty of any kind. Without limiting the foregoing, we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement and any warranties arising out of course of dealing or usage of trade.
We make no warranty that the Services or Products will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content.
25. Indemnity
You will indemnify and hold harmless The Perennial Truth Foundation (“TPTF”) and its officers, directors, employee and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Services or Content or (ii) your violation of these Terms.
26. Limitation of Liability
Neither “TPTF” nor any other party involved in creating, producing, or delivering the Services, Products or Content will be liable for any incidental, special, exemplary or consequential damages, including, but not limited to, lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute Services or Products arising out of or in connection with these terms or from the use of or inability to use the Services, Products or Content, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not “TPTF” has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
In no event will TPTF’s total liability arising out of or in connection with these terms or from the use of or inability to use the Services, Products or Content exceed the amounts you have paid to “TPTF” for use of the Services, Products or Content or fifty dollars ($50), if you have not had any payment obligations to “TPTF”, as applicable. The exclusion and limitations of damages set forth above are fundamental elements of the basis of the bargain between “TPTF” and you.
27. Dispute Resolution
27.1 Governing Law
These Terms and any action related thereto will be governed by the laws of the Government of South Africa without regard to its conflict of laws provisions.
27.2 Agreement to Arbitrate
You and “TPTF” agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services, Products or Content (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right: (i) to bring an individual action in small claims court and (ii) to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents or other intellectual property rights (the action described in the foregoing clause (ii), an “IP Protection Action”). Without limiting the preceding sentence, you will also have the right to litigate any other Dispute if you provide “TPTF” with written notice of your desire to do so by email at support@theprennialtruthfoundation.org within thirty (30) days following the date you first agree to these Terms (such notice, an “Arbitration Opt-out Notice”). If you don’t provide “TPTF” with an Arbitration Opt-out Notice within the thirty (30) day period, you will be deemed to have knowingly and intentionally waived your right to litigate any Dispute except as expressly set forth in clauses (i) and (ii) above. The exclusive jurisdiction and venue of any IP Protection Action or, if you timely provide “TPTF” with an Arbitration Opt-out Notice, will be the state and federal courts located in the Northern District of California and/or the Government of South Africa and each of the parties hereto waives any objection to jurisdiction and venue in such courts. Unless you timely provide “TPTF” with an Arbitration Opt-out Notice, you acknowledge and agree that you and “TPTF” are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, unless both you and “TPTF” otherwise agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” section will be deemed void. Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of these Terms.
27.3 Arbitration Rules
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this Section.
27.4 Arbitration Process
A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a general Demand for Arbitration form and a separate form for Demand for Arbitration for California residents.) The arbitrator will be either a retired judge or an attorney licensed to practice law and will be selected by the parties from the AAA’s roster of arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.
27.5 Arbitration Location and Procedure
Unless you and “TPTF” otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of the documents that you and “TPTF” submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.
27.6 Arbitrator’s Decision
The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award of damages must be consistent with the terms of the “Limitation of Liability” section above as to the types and amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. If you prevail in arbitration you will be entitled to an award of attorneys’ fees and expenses, to the extent provided under applicable law. “TPTF” will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys’ fees and expenses if it prevails in arbitration.
27.7 Fees
Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, ‘TPTF’ will pay all such fees unless the arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).
27.8 Changes
Notwithstanding the provisions of the “Modification” section above, if “TPTF” changes this “Dispute Resolution” section after the date you first accepted these Terms (or accepted any subsequent changes to these Terms), you may reject any such change by sending us written notice (including by email to support@theperennialtruthfoundation.org) within 30 days of the date such change became effective, as indicated in the “Last Updated” date above or in the date of SOS’s email to you notifying you of such change. By rejecting any change, you are agreeing that you will arbitrate any Dispute between you and “TPTF” in accordance with the provisions of this “Dispute Resolution” section as of the date you first accepted these Terms (or accepted any subsequent changes to these Terms).
28. General Terms
These Terms constitute the entire and exclusive understanding and agreement between “TPTF” and you regarding the Services, Products and Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between “TPTF” and you regarding the Services, Products and Content. If any provision of these Terms is held invalid or unenforceable (either by an arbitrator appointed pursuant to the terms of the “Arbitration” section above or by court of competent jurisdiction, but only if you timely opt out of arbitration by sending us an Arbitration Opt-out Notice in accordance with the terms set forth above), that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without TPTF’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. “TPTF” may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
Any notices or other communications provided by “TPTF” under these Terms, including those regarding modifications to these Terms, will be given: (i) by ‘TPTF’ via email; or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.
TPTF’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of “TPTF”. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.

CORONA VIRUS AND OTHER CONTAGIOUS ILLNESS
I acknowledge that I am not currently suffering with any contagious illness. I further acknowledge that The Perennial Truth Foundation cannot guarantee that I will not become infected with the Coronavirus/Covid-19 and or any other illness. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, other The Perennial Truth Foundation clients, participants and their families.
I voluntarily seek services provided by The Perennial Truth Foundation and acknowledge that I must comply with all set procedures to reduce the spread of any illness while attending my appointment/sessions. I attest that, I am currently not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell and or any form of illness that will affect the quality of the experience for myself and/or for other participants.
I hereby release and agree to hold The Perennial Truth Foundation harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in connection with any services received from The Perennial Truth Foundation . I understand that this release discharges The Perennial Truth Foundation from any liability or claim that I, my heirs, or any personal representatives may have against the Foundation with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from The Perennial Truth Foundation. This liability waiver and release extends to the school together with all owners, partners, and employees.

Admissions Indemnity:
By placing my booking, I hereby declare that:-
• I agree to participate voluntarily in the activities presented by The Perennial Truth Foundation
• I fully understand that the Tiger Sanctury is not open to the public and that I am not allowed access to this area
• I have understood and accepted the Disclaimer, Indemnity and Booking Terms, Conditions, Rules and Procedures of the Foundation PRIOR to making my booking
• I accept that I will make use of the facilities at my own risk and hereby absolve all parties listed in above paragraph and/or his employees and affiliates in respect of any damage, accident, injuries, sickness, cost or expenditure of whatever nature to persons or property arising from these activities.
• I, together with my heirs, executors and administrators hereby release the “The Perennial Truth Foundation NPC, Trust Entity & Sanctuary”, its subsidiaries, owners, board members and any employee and representative, facilitator or contractor against any and all liabilities and claims that could accrue to me or my heirs, executors and administrators due to illness, injury, death or loss of or damage to property arising out of my participation of the above mentioned activities, irrespective of whether such claim or claims arose as a result of any act or omission (whether by negligence or not) of any person or from any cause whatsoever.
• The Perennial Truth Foundation , its owners, trustees and any employee and representative or contractor accepts no liability for death, injury, illness or loss of or damage to property arising out of my participation in the above mentioned activities whatsoever.
• I fully understand and accept the terms of conditions hereof and certify that the contents hereof has been communicated to any beneficiaries I may have.
• I hereby warrant that I am a major and do not require my guardians consent

I fully understand that all teachings from the facilitators at The Perennial Truth Foundation and the online programs are for my self growth only and that I cannot teach this knowledge on my own accord or share any processes thereof unless I have completed the full training course and have been accredited thereof.
TERMS OF BOOKING SERVICE
The Perennial Truth Foundation is a privately owned Sanctuary and ALL RIGHTS OF ADMISSION IS RESERVED BY THE TRUSTEES.
Each person enters The Perennial Truth Foundation at his / her own risk. The owner, management and employees are not responsible for any damage, injury or loss of any nature sustained by a visitor, guest, contractor or any other person visiting the Foundation. Upon entry of the premises of the The Perennial Truth Foundation it is deemed that you have read, understood and accepted this Disclaimer & Indemnity Terms. And that you agree to follow the Rules and Procedures of the Sanctuary as communicated thereof.
Not Allowed on the Premises :
· Smoking
· Drinking Alcohol
· Drugs or Hallucinogens
· Firearms
· No Food or Drinks other than water
· No Bags, no cellphones and no cameras and/or any other digital devices and equipment are allowed
You may bring:
A blanket to keep warm
Socks for the cold floor tiles
No leather products should be worn. You should eat or drink 2 hours prior to any session held at the school.
SILENCE IS OBSERVED AT ALL TIMES unless otherwise guided by the facilitators. Ensure booking times are respected and adhered to. Access to the Tiger Enclosure is strictly prohibited unless you have actually booked a retreat with Amar and Taara. No loitering or random watching is permitted for the respect, protection and safety of Amar and Taara. The Sanctuary is not a ZOO and Amar and Taara are NOT trophy animals.
All personal belongings can be safely kept in your vehicle or at the registration desk.
Notes:
1. Parking is limited to dedicated parking bays only
2. Under no circumstances may visitors move around the property of the School or Sanctuary unattended
3. No Littering permitted
4. Keep Toilets clean after use
5. No damage to any plant or wild life permitted
6. Adhere to all signs and markings within the Sanctuary
7. Ensure ALL terms and conditions of this Disclaimer & Indemnity are followed, respected and adhered to. Any persons breaching these terms and conditions will be asked to leave immediately with no refund or opportunity for entry again.
Entry to the Meditation Hall and Healing Room starts at the reception area for booking confirmation and orientation.
BOOKING PROCEDURES
All correspondence with the School must be received in writing via our online bookings system. No telephonic, whatsapp or other verbal communication will be deemed binding in any way.
Times: Session times are as per individual booking information and communication thereof.
Cancellation Policy :
There is a strict No Show, No Refund Policy. There are No Refunds and No Credits if you change your mind or cancel a booking for any reason, in any time frame, so please be sure when you book. For Free programs the Foundation reserves the right to refuse entry should there be an abuse of cancellations. Sessions may be rescheduled by the Foundation due to unforeseen circumstances and communication will be sent thereof.
Payment : All bookings are only confirmed on payment confirmation. This includes Free programs. Proof of EFT payment can be emailed to bookings@theperennialtruthfoundation.org.
Arrivals: Please note: All guests must arrive 15 minutes earlier for individual consultation sessions and 30 minutes earlier for retreats and group programs. Late arrivals will result in all scheduled sessions being shortened accordingly, as a courtesy to the next client. Arrival after your scheduled booking start time will result in cancellation of the session with no refund. For groups programs, gates close 15 minutes prior to the scheduled start time of the group program. Entry will be refused to late comers.
If you Uber to the Sanctuary or be dropped off, the Uber driver or driver should drop you off outside of the Sanctuary main gates. You need to use the intercom buzzer at the entrance wall to buzz the reception desk to be let into the premises. The buzzer is placed at the door entrance.
With respect to our neighbours NO HOOTING or shouting is allowed to gain entry. We do not have our phones on us on the event day so please ensure preparation is done a day in advance and questions asked accordingly.

The Perennial Truth Foundation and it’s Meditation Sanctuary is a safe and secure environment and its members are dedicated to ensuring your safety and true authentic experience of your session, however these rules and regulations are put in place to educate, protect and enhance human values and behaviour.
Respect reflects your moral code:
Respect the sanctuary facilitators and their time allocated to the programs as well as the group and individuals in the program. When you book for a program ensure you are committed to the FULL time allocated and then some because most of our programs tend to go over time due to questions and community connect. As a private sanctuary resources are limited and hence gates open 15 to 30 minutes prior to the session time and 15 minutes after the end of the session time for all to depart at the same time. We do not accommodate any personal requests on time management.
We guarantee an awakening experience at our Sanctuary and we thank you in advance for your understanding and support to maintaining a high pranic space.
We do not take cash at the Sanctuary. Payment for product purchases, membership plans or bookings can be made via EFT for local participants or users or use the easy Payfast platform for credit card and other payment options. Bookings are only confirmed upon receipt of payment confirmation.
